CLE WEBINAR: HON. ELIZABETH BONINA (Ret.) INVITED TO PRESENT “AVOIDING ETHICAL PITFALLS IN ADR” TO THE ABA

New York, NY (March 5, 2021) – NAM  (National Arbitration and Mediation), one of the nation's leading providers of Alternative Dispute Resolution (ADR) services, is pleased to announce that NAM neutral, Hon. Elizabeth Bonina has been invited to present to the American Bar Association (ABA), a 60-minute CLE webinar entitled, Avoiding Ethical Pitfalls in ADR. This live streaming program is opened to the public and will be held on Wednesday, March 31st at 12 p.m. ET.

Judge Bonina and co-presenter Andrea Bonina will explore ethical considerations as they relate to settlement negotiations generally and with opposing counsel, issues relating to the representation of the client, problems that may arise with respect to the parties that attend the mediation, confidentiality, conveyance of demands and offers, disclosure of new information, insurance issues, the submission of pre-mediation submissions and other topics. The course will focus on the ethical obligation to negotiate in good faith and strategies of a proactive approach by counsel to head off bad faith behavior.

Attendees will learn how to avoid ethical pitfalls while conducting mediations and arbitrations.  Topics will include:

  • client communication (Rules 1.2 and 1.4),
  • good faith in the negotiation process (Preamble subsection 5),
  • conflicts of interest (Rule 1.7),
  • dealing with clients with diminished capacity and when leave of the court may be required prior to engaging in the Alternative Dispute Resolution process (Rule 1.14), and
  • decorum before the ADR tribunal (Rule 3.5).
