Honorable Ben R. Barbato, joins NAM after serving as a Justice of the Supreme Court, Bronx County. While on the bench, Judge Barbato presided over innumerable jury trials and summary jury trials in personal injury, negligence and tort cases. As one of the Judges in the Summary Jury Trial (SJT) part, a voluntary program created to reduce the Court’s backlog and wait time for jury trials, Judge Barbato’s dedication and understanding of its importance to the Bronx community resulted in it becoming the number one court program in the state. While sitting in the SJT part, Judge Barbato conducted more than 800 Summary Jury Trials in addition to pre-trial evidentiary hearings and settlement and charge conferences.
Following his time in the SJT part, he was assigned to a Trial Part where he presided over trials and conducted pre-trial discovery and settlement conferences. Judge Barbato issued well over 3,000 orders and decisions involving differing legal disciplines for a wide variety of matters including motor vehicle actions, trip and falls and slip and falls, premises liability, foreclosures, mental hygiene hearings and construction/labor law matters.
Judge Barbato also handled residential and commercial foreclosure cases pending in the Foreclosure Part and matters in the Tax Certiorari Calendar Part, where he resolved many of the cases during settlement conferences. Additional judicial assignments included conducting hearings and presiding over Mental Hygiene Law applications to determine the administration of medication and/or medical procedures over a patient’s objection.
Prior to his time on the Supreme Court bench, Judge Barbato was elected Judge of the Civil Court of the City of New York where he presided over multiple jury trials – including personal injury cases and commercial/contractual disputes. He also conducted hearings that involved consumer credit matters and was instrumental in settling many of those cases through negotiation. Further, he also heard disputes involving physician/medical fees pursuant to the NYS No Fault Law.
As a private practitioner, he litigated hundreds of personal injury disputes in a variety of case types that involved slip and fall, trip and fall, residential liability, motor vehicle accidents and labor law. He has negotiated both residential and commercial real estate leases and conducted real estate closings. Judge Barbato also has experience handling family and matrimonial matters that include child custody and support, spousal support and maintenance and equitable distribution of marital property disputes.
In 2017, Judge Barbato was named Judge of the Year by the Bronx County Bar Association and Bronx Advocates of Justice. For seven years, he was an Adjunct Professor for Lehman College Paralegal Studies program and was named Acting Chair of the Department in 2005. He also worked for the Speaker of the New York State Assembly where he authored the 1993 Reverse Mortgage Bill passed by the Senate and Assembly and signed by Governor Mario Cuomo.
Judge Barbato has always been dedicated to assisting attorneys and parties in the settlement and resolution of their cases. He is known for his fair interpretation and application of the law and his approachable demeanor.
