HON. E. MICHAEL KAVANAGH'S ARTICLE ON THE BENEFITS OF THE APPELLATE ORAL ARGUMENT TO BE PUBLISHED IN THE NEW YORK LAW JOURNAL SPECIAL REPORT

NAM is proud to announce that an article written by Honorable E. Michael Kavanagh entitled, The Oral Argument-An Absolute Must When Appealing A Case, will be published on Monday, August 21, 2017 by the New York Law Journal, as part of its Court of Appeals and Appellate Practice Special Report.

In the article, Hon. Kavanagh, reflects on his years of experience as an Associate Justice of the Appellate Division and encourages practitioners to request oral argument if permitted on an appeal. In discussing the benefits, he offers suggestions to counsel on how best to prepare for the oral argument and how to address the bench's questions during the argument. Judge Kavanagh stresses the importance of being thoroughly prepared to answer any and all questions, the significance of which is “…how counsel responds to questions posted by the court during oral argument can make a difference, and can determine how a particular judge will ultimately vote on the appeal.”

For the fourth year in a row, Hon. Kavanagh has been ranked a Top Ten Arbitrator in the 2016 New York Law Journal Annual Reader Rankings Survey. He has arbitrated and mediated hundreds of cases including Complex Commercial, Construction, Labor and Employment, Legal Malpractice, Product Liability and Personal Injury matters.
