NAM panel members Hon. Peter B. Skelos, David S. Feather, Esq. and Hal Neier, Esq. will present a CLE seminar entitled “Reasonable Accommodation in the Workplace Under the ADA / Recent Trends and Practical Tips When Dealing With Restrictive Covenants and Trade Secrets” to the law firm of Epstein Becker & Green P.C. The 90-minute CLE panel discussion will be held at Epstein Becker & Green located at 250 Park Avenue, 14th Floor, New York, NY 10177 on Wednesday, December 7, 2016 at 11:30 a.m.
The CLE presentation will address the issue of reasonable accommodation under the Americans with Disabilities Act (ADA) in connection with telecommuting, the criteria an employer should consider in determining whether a leave of absence or telecommuting are reasonable accommodations for an employee with a disability, restrictive covenants and the “legitimate interests” of employers that may be protected by them, trade secrets under New York law, proposed New York State legislation and the use of mediation and arbitration to resolve these types of claims and best practice tips for advocates handling them.
Hon. Peter B. Skelos is a former Associate Justice of the Appellate Division of the New York State Supreme Court, 2nd Department. Hon. Skelos is well-versed in the law and is a highly regarded mediator and arbitrator for NAM. He hears a wide variety of case types including construction, commercial, professional liability, insurance coverage, matrimonial, medical malpractice and personal injury matters. Judge Skelos was voted a Top Ten Mediator by the 2016 New York Law Journal Annual Reader Rankings Survey.
David S. Feather, Esq. has dedicated his career to the practice of labor and employment law. He has represented both employees and employers/management in the State and Federal Courts, and regularly appears before the Equal Employment Opportunity Commission, the New York State Division of Human Rights and the Nassau County Commission on Human Rights. Mr. Feather has represented unions and union members in grievances and arbitrations pursuant to collective bargaining agreements, and has negotiated, drafted, litigated and mediated employment contracts, severance agreements and non-compete agreements on behalf of both employers and employees.
Hal Neier, Esq. is a longtime proponent of Alternative Dispute Resolution (ADR). As a commercial litigator, he has handled a wide variety of matters including employment, commercial, intellectual property and professional malpractice. He has arbitrated and mediated claims involving breach of contract, breach of fiduciary duty, violations of restrictive covenants, wrongful termination, securities fraud, and trademark/copyright infringement.
