NAM panel members Richard P. Byrne, Esq., Hon. Peter B. Skelos and Hon. Ira B. Warshawsky have been invited by the firm Forchelli, Curto, Deegan, Schwartz, Mineo & Terrana LLP to participate in a 90-minute CLE panel discussion on Thursday, June 16, 2016. The seminar, entitled Mediating Construction Defect Claims, will focus on the use of mediation to settle complex construction claims in lieu of costly and time-consuming litigation.
Construction defect claims often evolve into one of the most complex, expensive, and exasperating types of litigation. Litigating these cases typically involves numerous parties, extensive documentation, never-ending depositions and competing experts. This presentation will provide attorneys with practical tips on resolving these type of claims and will explore logistical issues and challenges, pre-mediation communications, aggregating the parties and their issues, required attendees, pre-mediation submissions and substantive and practical issues and challenges.
Richard Byrne, Esq. has mediated matters involving various areas of the law including construction and commercial disputes, employment discrimination, insurance coverage and property damage claims, risk transfer disputes and disability claims. For the second year in a row, he was voted one of the Top 3 Mediators in the country by The National Law Journal Annual Reader Rankings Survey (2016 and 2015) and named one of 48 2016 Alternative Dispute Resolution Champions in the U.S. by the same publication. Hon. Peter B. Skelos is a former Associate Justice of the Appellate Division of the New York State Supreme Court, 2nd Department. He is well-versed in the law and has handled a wide variety of case types as a judge, a litigator and a mediator including construction, commercial, professional liability, insurance coverage, medical malpractice and personal injury matters.
Hon. Ira B. Warshawsky is a former New York Supreme Court Justice in Nassau County's, Commercial Division. As a judge and mediator he has handled cases involving construction claims, business disputes including business valuation proceedings, corporate and partnership disputes, class actions, complex commercial cases and employment and labor law matters. He was named one of 48 2016 Alternative Dispute Resolution Champions in the U.S. by The National Law Journal. Hon. Warshawsky was also voted a Top 10 Mediator by The New York Law Journal Annual Reader Rankings Survey.
