He is best known for protecting clients’ interests worldwide in obtaining, defending and asserting intellectual property rights both in the courts and in effectively negotiating resolution of such disputes. In the course of his career he has been active in resolving patent disputes, complex licensing issues, trademark rights disputes, including controversies arising out of co-existence agreements; alleged trade secret violations; and copyright disputes, including issues relating to the appropriate compensation for usage.
As a first chair litigator, Mr. Schwab has significant experience litigating patent, copyright, trademark, unfair trade practices, International Trade Commission (ITC) proceedings and patent post-grant proceedings. Both as counsel and as a neutral, he has helped to fashion resolutions to complex matters. A senior and founding partner of Abelman Frayne & Schwab, a leading New York intellectual property law firm, he has represented many Fortune 500 businesses in both the United States and abroad as well as middle market and entrepreneurial start-ups.
Mr. Schwab is a longtime advocate of Alternative Dispute Resolution (ADR). In 1996, he was appointed Chairman of the New York Intellectual Property Association (NYIPLA) ADR subcommittee where he had the distinction of serving for 3 years. During that time, Mr. Schwab’s responsibilities included reviewing ADR activity-monitoring case law developments, recommending procedures for better use of ADR and advocating the benefits of ADR and its use in resolving intellectual property disputes. He has also served on the American Bar Association Committees on ADR and Litigation and the American Intellectual Property Law Association’s ADR and Federal Litigation Committees. Mr. Schwab’s in-depth knowledge about intellectual property matters coupled with his professional experience as a trial attorney makes him a highly effective neutral when arbitrating or mediating.
He has lectured on a myriad of issues relating to intellectual property particularly with respect to licensing and litigation and has been a guest lecturer at major corporations, internationally sponsored conferences, universities and law schools.
