HON. E. MICHAEL KAVANAGH (RET.) TO PRESENT WEBINARS ON MEDIATION AND ARBITRATION CLAUSES TO FIDELITY NATIONAL FINANCIAL

Michael Kavanagh (Ret.) has been invited to present two Continuing Legal Education (CLE) webinars to Fidelity National Financial. The two 60-minute CLE programs are entitled The Basics of Mediation and Arbitration Clauses: Specificity Reduces Dispute Time and Costs and will be presented on Thursday, April 2nd from 2:00 – 4:00 p.m
The Basics of Mediation
In the first program, Judge Kavanagh will draw upon his many years of experience as a former New York Associate Justice, Appellate Division, 1st and 3rd Departments, and address how mediation offers a number of advantages over formal litigation. That includes lower cost, less time required to achieve resolution, no adverse publicity and greater control over the outcome of the dispute, among others. The program will define and elaborate on some of the moving parts that make up the mediation process.
Arbitration Clauses – Specificity Reduces Dispute Time and Costs
The second program will be devoted to drafting arbitration clauses and the importance of specificity within that clause. Poorly crafted, vague clauses can hinder the resolution of a dispute. Judge Kavanagh will address the importance of streamlining the resolution of any dispute under the agreement, how to create a clause specific to the business transaction that will ultimately save time and reduce costs and the importance of selecting the right arbitrator.
