New York, NY (February 5, 2021) – NAM  (National Arbitration and Mediation), one of the nation's leading providers of Alternative Dispute Resolution (ADR) services, is pleased to announce that NAM neutrals, Hon. Alan D. Scheinkman (Ret.) and Jennifer Herscovici, Esq., have been invited to present to the New York State Academy of Trial Lawyers, a 60-minute CLE webinar entitled, Finding a Path to Justice Through Mediation. This free complimentary live streaming program is opened to the public and will be held on Tuesday, March 2nd at 1 p.m. EST.

Judge Scheinkman and Ms. Herscovici will be joined by trial attorney, Chris Holbrook, Esq., to discuss the differences between finding justice through trial, in court or at private mediation. Topics will include: the pros and cons of resolving a case in the courtroom vs. ADR, discussing the steps in preparing for a case before a jury or mediator, the logistical differences involved and more. Presenters will share their insights for success based on years of experience from the perspective of the Bench, the trenches of the courtroom, and the negotiation table.

About NAM's Presenters

Hon. Alan D. Scheinkman (Ret.) is a member of NAM's (National Arbitration and Mediation) Hearing Officer Panel and is available to arbitrate and mediate cases throughout the United States. Justice Scheinkman has had a remarkable legal career as both a judge and litigator. As the Presiding Justice of the Second Judicial Department of The New York State Supreme Court, Appellate Division, he has heard appeals of a wide variety complex litigation matters that included business disputes, labor and employment partnerships, landlord and tenant, commercial foreclosure cases, business receiverships, business torts (fraud and deceit, usurpation of business opportunities), matrimonial and family law, trusts and estates, defamation, land use and construction, health law and wage and hour cases. As an appellate judge, trial judge and litigator, he has handled all types of employment matters that include breach of contract, trade secrets, confidentiality agreements, covenants not to complete, wrongful termination, discrimination, sexual harassment, and wage and hour disputes.

Jennifer Herscovici, Esq. is a former Senior Counsel, Negotiator for the New York City Law Department's Tort Division. She has settled thousands of cases in actions involving claims of various types of negligence, labor law, defamation and civil rights violations. Additionally, her many years of trial practice experience has resulted in taking to verdict numerous high exposure cases. As a neutral for NAM, she draws from her significant experience handling complex negotiations and is recognized by her peers as an authority in negotiation and settlement.  Throughout her many years of experience negotiating cases and settling disputes, she has gained a reputation for her extensive knowledge in numerous areas of law including negligence, premises liability, tort and product liability and personal injury. Ms. Herscovici is an avid proponent of ADR and is known for her ability to evaluate cases, astutely assess the issues at hand and effectively guide parties and counsel to fair resolutions. Ms. Herscovici was voted a Top 10 Mediator by the 2020 New York Law Journal Best of Survey. She is available to arbitrate or mediate cases throughout New York State.
