NAM panel members Richard P. Byrne, Esq., Hon. Peter B. Skelos and Hon. Ira B. Warshawsky will present a 90-minute CLE seminar entitled “Learn From The Experts: Best Practices for Mediating Construction Defect Claims.” The seminar will provide attorneys with practical tips on the use of mediation to settle complex benefits and construction claim issues. Attendees will hear from the mediators, a construction attorney and an insurance professional, each of whom will bring their own perspective and experience to the discussions.
Construction defect claims are often incredibly complex, expensive and time consuming types of litigation. Numerous parties, extensive discovery, competing experts, underlying insurance coverage disputes and motion practice could cumulatively present the toughest challenges of the litigation process in one setting. This CLE program addresses the alternative route of mediation as a means to resolve these issues in a more cost-effective and time-efficient manner. Topics to be discussed are: Logistical Issues and Challenges; Pre-Mediation Communications; Aggregating the Parties and Their Issues; Structuring the Mediation Sessions; Pre Mediation Submissions; and Substantive and Practical Issues and Challenges.
NAM panelists will be joined by Jeffrey L. Schulman, Esq., a partner at Liner LLP and Carolyn J. Crawford, the Director of Construction Defects at Nationwide Insurance.
The NAM/New York Law Journal co-sponsored program will be held at NAM's New York City offices and also simulcast to their offices in Garden City, NY.

Judge Skelos is well-versed in the law and is a highly regarded mediator and arbitrator for NAM. He hears a wide variety of case types including construction, commercial, professional liability, insurance coverage, matrimonial, medical malpractice and personal injury matters.
Ira Warshawsky Hon. Ira B. Warshawsky is a former New York Supreme Court Justice, Commercial Division, Nassau County. As a judge and mediator/arbitrator, he has handled cases involving construction claims, business disputes including business valuation proceedings, corporate and partnership disputes, class actions, complex commercial cases and employment and labor law matters. He was named a National Law Journal 2016 Alternative Dispute Resolution Champion, as part of a select group of only 48 nationwide. For the third year, Hon. Warshawsky was also voted a Top 10 Arbitrator by the 2016 New York Law Journal Annual Reader Rankings Survey.
