NAM is proud to announce that Hon. John P. DiBlasi's article entitled When Drafting An Arbitration Clause, Specificity Matters, was published by the New York Law Journal on Monday, November 28, 2016 as part of its Alternative Dispute Resolution Special Report.
In the article, Judge DiBlasi addresses the use of arbitration clauses in contracts and the many considerations that should go into drafting the clause, including: the type of disputes that will be the subject of the arbitration, providing for mediation prior to arbitration, the right to award attorneys' fees, the selection of an ADR provider/administrator, providing for relief when a party does not cooperate and the use of a single arbitrator versus a tri-panel. Judge DiBlasi states, “The singular goal is to be as specific as possible to avoid litigating the very provision itself and delaying the ADR process.”
For the third year in a row, Judge DiBlasi was ranked the #1 Mediator in the United States by the National Law Journal Reader Rankings Survey (2016, 2015, 2014). In addition to being ranked #1 nationally, Hon. DiBlasi has been rated a Top 10 Mediator in New York State by the New York Law Journal's Annual Survey for seven consecutive years. He was also named a National Law Journal 2016 Alternative Dispute Resolution Champion, as part of a select group of only 48 nationwide. Judge DiBlasi holds an AV Preeminent peer rating from Martindale-Hubbell in both Alternative Dispute Resolution and Litigation – a distinction given only to those who possess the highest ethical standards and professional ability.
Judge DiBlasi is the former presiding Justice of the Commercial Division of the Supreme Court of the State of New York, Westchester County, and creator of the Alternative Dispute Resolution Program used successfully by that court. He has mediated over 3,000 cases and his ADR practice centers on resolving Commercial, International, Finance, Employment, Entertainment, Land Use, and Professional Malpractice matters. Judge DiBlasi hears cases throughout New York State, the United States and Internationally.
